These Terms of Service (“Terms”) govern your use of thecatwellness.com (the “Site”). By using the Site you agree to these Terms. If you do not agree, please stop using the Site.

1. About TheCatWellness

TheCatWellness is a research-backed publication about indoor cat health and behavior. We publish articles, guides and product recommendations. Some links on the Site are affiliate links; see our Affiliate Disclosure for details. The Site is operated by the team behind TheCatWellness. 2. Acceptance of these Terms

By accessing or using the Site you agree to be bound by these Terms and by our Privacy Policy. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. If you are younger, you may use the Site only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

4. Educational content only: not veterinary advice

The Site provides general educational information about cats. It is not veterinary advice and does not replace consultation with a licensed veterinarian. None of our writers are veterinarians. We summarize and link to research; we do not examine your cat. If your cat is unwell or you are worried about a symptom, contact a licensed veterinarian. Anything you read on the Site is at your own risk and discretion.

5. Intellectual property

All content on the Site (articles, images, illustrations, logos, layout, design, code) is owned by TheCatWellness or by the third parties that license it to us and is protected by copyright and other intellectual property laws. We grant you a limited, personal, non-commercial license to access and read the content on the Site through a standard web browser.

You may not copy, republish, redistribute, scrape, train machine-learning models on, sell or create derivative works from any content on the Site without our prior written permission, except for short quotations with attribution and a link back to the source page (as standard fair use allows).

6. User-submitted content

If you send us a message, leave a comment or otherwise submit content to us (“Submissions”), you grant us a non-exclusive, royalty-free, worldwide license to read, store, reproduce, adapt and display that Submission for the purpose of operating the Site and responding to you. You represent that your Submission does not infringe anyone else’s rights and is not unlawful, abusive, defamatory or otherwise objectionable.

We have no obligation to publish or keep any Submission. We may remove or edit Submissions at our discretion.

7. Affiliate links and product recommendations

Some links on the Site are affiliate links. If you buy through one of them, we may earn a small commission at no extra cost to you. Affiliate relationships do not influence our editorial recommendations. See our Affiliate Disclosure for full details. Any purchase you make is a contract between you and the third-party seller, not us. We are not responsible for the goods or services they provide.

8. Third-party links and services

The Site contains links to third-party websites and references third-party services we do not control. We are not responsible for the content, accuracy, privacy practices, products or services of any third party. Your dealings with third parties are between you and the third party.

9. Prohibited uses

You agree not to:

  • Use the Site in any way that violates applicable law.
  • Scrape, crawl, copy or otherwise collect content from the Site in bulk by automated means without our written permission. (Reasonable search-engine indexing is fine.)
  • Use the Site or any content from it to train, fine-tune or evaluate any machine-learning model without our prior written permission.
  • Attempt to gain unauthorized access to the Site, related systems or other users’ accounts or data.
  • Upload or transmit viruses, malware or harmful code.
  • Interfere with the Site’s normal operation, including by sending excessive requests or attempting to overload our servers.
  • Misrepresent who you are or impersonate any person.
  • Use the Site to send unsolicited messages, advertising or other commercial content.

10. Disclaimer of warranties

The Site and all content on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or that the Site will be uninterrupted, secure or error-free. We do not warrant that any information on the Site is complete, current or correct for your situation. You rely on it at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, TheCatWellness, its operators and contributors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of the Site or any content on it. Our total liability to you for any claim arising out of or relating to the Site is limited to US$50 or the amount you have paid us in the past 12 months, whichever is greater. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.

12. Indemnification

You agree to indemnify and hold harmless TheCatWellness, its operators, contributors and partners from and against any claim, liability, loss, damage or expense (including reasonable legal fees) arising out of (a) your use of the Site, (b) your violation of these Terms, (c) your Submissions or (d) your violation of any third-party right.

13. Suspension and termination

We may suspend or terminate your access to the Site at any time, for any reason, including for breach of these Terms. The provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will continue to apply.

14. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware and the federal laws of the United States, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, and you consent to personal jurisdiction and venue there.

15. Severability and waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms does not waive that right or provision.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top tells you when. For material changes we will post a notice on the Site before they take effect. Continued use of the Site after changes take effect means you accept the updated Terms.
